ShopDoc Digital Platform Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ShopDoc digital platform, including the ShopDoc website, ShopDoc mobile app for patients and practitioners, and all other communication and service channels (collectively referred to as the "Platform"). The Platform is owned and operated by MobeedCare Pvt Ltd ("MobeedCare," "we," "us," or "our"). By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with any part of these Terms, you may not access or use the Platform.

1. Use of the Platform

a. Eligibility: You must be at least 18 years old to access or use the Platform. By accessing or using the Platform, you represent and warrant that you are at least 18 years old.

b. Registration: To access certain features of the Platform, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

c. User Accounts: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2. Medical and Healthcare Services

a. Provider-Patient Relationship: The Platform facilitates communication between patients and healthcare providers. However, MobeedCare is not a healthcare provider and does not provide medical or healthcare services. We do not establish or control the terms of any provider-patient relationship.

b. Medical Disclaimer: We do not endorse or recommend any specific healthcare providers or services. Any information provided on the Platform, including but not limited to educational content, is for informational purposes only and should not be considered medical advice. Always seek the advice of a qualified healthcare professional regarding medical conditions or treatment options.

c. Provider Listings: Provider listings on the Platform are for informational purposes only and may not be complete or up-to-date. We do not guarantee the accuracy, completeness, or suitability of any provider listing.

d. Liability Disclaimer: MobeedCare is not liable for any medical or healthcare services provided by healthcare providers or service providers listed on the Platform. We are not responsible for any actions or omissions of healthcare providers or service providers.

3. User Conduct

a. Compliance: You agree to comply with all applicable laws, regulations, and these Terms when using the Platform.

b. Prohibited Activities:You may not engage in any conduct that:

i. Violates these Terms or any applicable laws or regulations;

ii. Infringes upon the rights of others;

iii. Harasses, intimidates, or discriminates against others;

iv. Interferes with the operation of the Platform or any user's enjoyment of the Platform;

v. Contains viruses, malware, or other harmful code;

vi. Attempts to gain unauthorized access to the Platform or any user accounts; or

vii. Engages in any other conduct deemed inappropriate by MobeedCare.

4. Intellectual Property

a. Ownership: The Platform and all content, features, and functionality thereof are owned by MobeedCare or its licensors and are protected by copyright, trademark, and other intellectual property laws.

b. License: Subject to these Terms, MobeedCare grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use.

5. Privacy

Your use of the Platform is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the Platform, you consent to the terms of our Privacy Policy.

6. Modification and Termination

a. Modification: MobeedCare reserves the right to modify or discontinue the Platform or any part thereof at any time without notice.

7. Cancellation, rescheduling, and refund

Cancellation, rescheduling, and refundpolicies for appointments made through the Platform are subject to the individual policies of the medical practitioners or healthcare service providers. MobeedCare is not responsible for any cancellation, rescheduling, or refund requests, and you agree to directly address such matters with the relevant provide

b. Termination: MobeedCare may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Kerala.
