ShopDoc Digital Platform Terms of Service for Medical Practitioners and Healthcare Service Providers

1. Introduction

These Terms of Service ("Terms") govern your use of the ShopDoc digital platform as a medical practitioner or healthcare service provider ("Provider") affiliated with MobeedCare Pvt Ltd ("MobeedCare," "we," "us," or "our"). By accessing or using the ShopDoc platform, you agree to comply with these Terms. If you do not agree with any part of these Terms, you may not access or use the ShopDoc platform.

2. ShopDoc Digital Platform and Affiliates

a. ShopDoc Platform: The ShopDoc digital platform includes the ShopDoc website, ShopDoc mobile app for patients and practitioners, and all other communication and service channels owned and operated by MobeedCare.

b. Affiliates: Affiliates of ShopDoc include any entities, partners, or service providers associated with MobeedCare in the provision of healthcare services through the ShopDoc platform.

3. Provider Registration and Account

a. Eligibility: To register as a Provider on ShopDoc, you must hold valid licenses and certifications required to practice in your field of expertise. By registering as a Provider, you represent and warrant that you meet these eligibility requirements.

b. Account Creation: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Services Offered

a. Healthcare Services: As a Provider on ShopDoc, you agree to offer healthcare services within your area of specialization. You acknowledge and agree that MobeedCare does not provide medical or healthcare services and is not responsible for any actions or omissions of Providers.

b. Non-Liability: You understand and agree that MobeedCare is not liable for any medical negligence, errors, or problems related to your services, the information you provide, your medical licenses, or any other aspect of your practice.

5. Payment and Fees

a. Payment Collection: MobeedCare collects payments on behalf of Providers for services rendered through the ShopDoc platform. Payments will be transferred to Providers on a bi-weekly or monthly basis, after deducting a certain percentage of the agreed ANGEL fee, which includes service and platform fees.

6. Patient Data Protection

a. Patient Confidentiality: As a Provider on ShopDoc, you agree to protect the confidentiality and privacy of patient data in accordance with applicable laws and regulations. You shall not disclose or use patient information for any purpose other than providing healthcare services through the ShopDoc platform

b. Data Collection: You acknowledge and agree that MobeedCare has the right to collect and access full information about a patient's condition, medical reports, e-prescriptions, diagnostic reports, consultation reports, observations, and other relevant data necessary for providing and maintaining healthcare services.

7. Timely Updates and Refunds

a. Platform Updates: You agree to provide timely updates to patient records, treatment plans, prescriptions, and other relevant information on the ShopDoc platform.

b. Refunds: If a patient is unsatisfied with any services or consultations provided through the ShopDoc platform, you agree to issue a refund in accordance with MobeedCare's refund policy.

8. Healthcare Service Providers

a. Definition: For the purposes of these Terms, "healthcare service providers" include individual medical practitioners listed on ShopDoc as well as entities such as clinics, hospitals, laboratories, fitness centers, mental health counseling centers, wellness centers, physiotherapy centers, yoga centers, nutrition clinics, and any other entities offering healthcare services.

9. Modification and Termination

a. Modification: MobeedCare reserves the right to modify or discontinue the ShopDoc platform or any part thereof at any time without notice.

b. Termination: MobeedCare may terminate or suspend your access to the ShopDoc platform immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the ShopDoc platform shall be subject to the exclusive jurisdiction of the courts of Kerala
